Chapter 13 Instructions after Case has been filed:
We will send you the time and date of your 341 Zoom Hearing. Please place this on your calender. You will need to make sure you are somewhere quiet without background noise. The session is a 30 minute session, when they actually call your case it should be 5 minutes. Please call our office a few days before the zoom meeting to go over the types of questions that will be asked. This is a link to a document the trustee may ask if you read. Bankruptcy Info Sheet. Our office will upload your documents to the trustee.
You will need to start your bankruptcy trustee payments. 1st payment is due approximately one week before your 341 Zoom hearing. You can set up your payments on https://tfsbillpay.com Because the payment is a monthly amount, simply split the payment amount in two if you want to set up biweekly payments on TFS billpay. If you do not recall what the payment amount is, contact our office. Missed payments will result in the Chapter 13 trustee cancelling your bankruptcy.
You will need to remain current on mortgage and vehicles you are keeping. If your mortgage or vehicle company removes online access, you can pay over the phone or set up billpay. Please contact our office if you need assistance clarifying how to make the mortgage and car payments. Late payments can lead to foreclosure, repossession and hefty late fees and attorney fees if a Motion to Lift Stay is filed due to late/missed payments. Changes in mortgage payment amounts due to escrow or other reasons during your bankruptcy will be mailed notice of payment change. It is your responsibility to ensure you are checking your mail and that your mortgage is being paid on time and in the correct amount. We can provide your mortgage company with a letter granting permission for them to talk to you over the phone or mail documents if necessary. Ask our office for details if they request this letter.
After the 341 Zoom hearing, there will be an update approximately one month after the zoom. The confirmation hearing (which is the hearing a month after the zoom hearing) may be rescheduled. If the trustee files an “Objection to Confirmation” that is normal and the issues need to be resolved before they approve your plan. Also if there is a court notice stating “Denied with Leave to Amend” this just means your confirmation hearing was rescheduled, the new dates will be at the bottom of the notice. Please continue trustee chapter 13 payment, mortgage, vehicles, HOA, utilities, cell phone, insurance payments etc. It may take several months for the payment amount to the trustee to become finalized.
We will update you if we need additional paperwork (more paystubs, tax returns, bank statements, proof of monthly expenses for you or your partner).
